02Contract Subject
This agreement governs the rights and obligations of the parties regarding the sale, delivery, and use of digital credit packages known as Kitchen Points (MP) and/or subscription services ordered electronically by the BUYER through the SELLER's website gurmion.com.
03Service/Product Information
Product Type: Digital Content and Service (Kitchen Points - MP)
Description: A virtual credit unit that grants access to AI-powered gastronomy tools on the Gurmion platform (Visual Gourmet, Menu Engineer, Kitchen LLM Chat, etc.). MP is not real currency and is only valid for in-platform transactions.

04Payment and Delivery Terms
- Payment Method: Credit Card / Debit Card (processed via Iyzico secure payment infrastructure. Your card details are not stored on Gurmion servers.)
- Delivery Type: Digital delivery. Instantly credited to your Gurmion account after payment confirmation and ready for use.
- Delivery Time: Maximum 5 minutes (usually instant)
- Invoice: Sent to your registered email address via our e-Invoice/e-Archive Invoice system.
05Satisfaction Guarantee (7 Days)
Since the parties act in the capacity of merchants, the statutory right of withdrawal under consumer law does not apply to this agreement. Instead, the SELLER grants, under the principle of freedom of contract, a voluntary satisfaction guarantee valid for entirely unused credits within 7 days of purchase.
⚠️ Important Limit (Used Credits):
This guarantee applies only to entirely unused credits; for instantly performed digital services that have begun being used, no refund may be requested after use.
Therefore: Once you begin using Kitchen Points (MP), the satisfaction guarantee expires. However, for completely unused credits, you may request a full refund within 7 days of purchase.

06Rights and Obligations of the Parties
BUYER's Obligations:
- Provide accurate and up-to-date information
- Fulfil payment obligations
- Comply with terms of use
- Maintain account security
SELLER's Obligations:
- Make every effort to provide uninterrupted service
- Protect personal data in accordance with KVKK
- Issue and deliver invoices
- Fulfil lawful refund requests
07Contract Duration and Renewal
- For one-time credit packages, the contract expires when all credits are used or on the expiry date if one is specified.
- For subscription packages, the contract automatically renews at the end of the specified period. The BUYER may cancel before the renewal date.
- Either party may terminate the contract while reserving their legal rights.
08General Provisions
- The BUYER declares that they have read, understood, and accepted all terms of this agreement.
- The contract is formed electronically and electronic records are accepted as legal evidence (Turkish Commercial Code Art. 18/3, Code of Civil Procedure Art. 199).
- Customs duties, VAT, and other legal obligations are included in the price.
- The SELLER may temporarily suspend the service in case of technical failures or force majeure events.
- The parties shall notify each other within 3 days if their contact information changes.
09Dispute Resolution
The following authorities are competent to resolve any disputes arising from this agreement:
- Mandatory Mediation: For commercial disputes, applying to mediation is mandatory before filing a lawsuit (Law No. 6325).
- Competent Court: If the dispute cannot be resolved, the Istanbul (Çağlayan) Commercial Courts and Enforcement Offices are competent.
- Governing Law: The parties hold the capacity of merchants, and disputes are interpreted under the Turkish Code of Obligations and the Turkish Commercial Code.
10Declaration and Acceptance
I have read, understood, and accept the contents of this Distance Sales Agreement. By completing the payment process, I am deemed to have approved this agreement electronically.
